Анотація: У статті розглянуто питання, пов’язані з розвитком нового наукового напрямку — правової інформатики як міждисциплінарної галузі знань, особливу увагу приділено теоретико-методологічним основам системного підходу, його принципам і напрямкам, а також перспективам його використання як методу правової інформатики. Заслуговують на увагу новітні технології у підготовці висококваліфікованих, компетентних, конкурентоспроможних правників, здатних ефективно виконувати науково-дослідні, фахові завдання, відповідати запитам сьогодення. Вирішення цих завдань знаходить відображення в змісті такого наукового напрямку та навчальної дисципліни, як «Правова інформатика». Діапазон проблем, що досліджуються і розв’язується правовою інформатикою, — від опрацювання правових даних до отримання нових знань і прийняття управлінських рішень в інтересах громадян, суспільства, законодавчої, виконавчої та судової влади. Особливої уваги в методах навчання дисципліни заслуговує системний підхід. У роботі розглянуто основні категорії системного підходу: система, структура і середовищ, зазначено, що ключовою ланкою системного підходу в праві є поняття «система». Застосування системного підходу в правовій інформатиці дозволяє виявити такі характеристики: цілісність, зв’язок, структуру і організацію, рівні системи та їх ієрархію, управління, самоорганізацію системи, її функціонування і розвиток. Основна ідея системного підходу в контексті навчання правовій інформатиці полягає в розгляді навчальних завдань у тісному взаємозв’язку із засобами, методами інформатики та процесами галузі права. У дослідженні запропоновано загальну схему етапів системного підходу в дослідженнях правової інформатики, інформаційно-кібернетичний ланцюг регулювання правової системи, визначено, що правова система є складною відкритою, нерівноважною соціальною інформаційно-кібернетичною системою, що забезпечує правове регулювання суспільних відносин, їй притаманні значна динамічність, невизначеність. Використання системного підходу під час навчання правовій інформатиці розвиває самостійність і креативність мислення студентів, формує фахові компетентності, стимулює їх до науково-дослідної діяльності.
Abstract: In the article questions are examined related to development of new scientific direction — legal informatics as interdisciplinary area of knowledge, the special attention is spared to теоретико-методологічним bases of approach of the systems, his principles and directions, and also to the prospects of his use as method of legal informatics. Deserve attention of the newest technologies in preparation of highly skilled, competent, competitive legislators, capable effectively to execute research, professional tasks, answer the queries of present time. The decision of these tasks finds a reflection in maintenance of such scientific direction and educational discipline as the «Legal informatics». Range of problems that is investigated and gets untied by a legal informatics — from working of legal data to the receipt of new knowledge and acceptance of administrative decisions in interests of citizens, society, executive and judicial legislature. The special attention in the methods of studies of discipline is deserved by approach of the systems. The basic categories of approach of the systems are in-process considered: system, structure and environments, it is marked that the key link of approach of the systems in a right is a concept «system». Application of approach of the systems in a legal informatics allows to educe such descriptions: integrity, connection, structure and organization, even systems and their management of the system, it’s functioning and development. The basic idea of approach of the systems in the context of studies to the legal informatics consists in consideration of educational tasks in close intercommunication with facilities, methods of informatics and processes of the field of law. In research the general chart of the stages of approach of the systems offers in researches of legal informatics, informatively-cybernetic chain of adjusting of the legal system, certainly, that the legal system difficult, non-equilibrium social informatively-cybernetic opens system, that provides the legal adjusting of public relations, the considerable dynamic, vagueness is inherent her. The use of approach of the systems during studies to the legal informatics develops independence and creativity of thinking of students, forms to the profession of competence, stimulates them to research activity.
